Worker’s Compensation Insurance: the Basics
Worker’s Compensation insurance generally covers workers when they are injured on the job. If one is hurt, then the Worker’s Compensation Insurance may cover all of or part of their medical expenses and lost wages up to a certain threshold amount.
Worker’s Compensation Insurance generally does not cover injuries that result from willful or/and intentional misconduct.
In most states, the Worker’s Compensation Insurance is paid for by the employer and not by the person who is injured. In most cases, it is mandated by law that employers carry Workers’ Compensation coverage with most states allowing exemptions only in very narrowly defined circumstances.
Failing to maintain a Worker’s Compensation Insurance policy can result in significant fines and penalties.
In most states, an employer is not entitled to a reimbursement from a Worker’s Compensation Insurance carrier for indemnity payments made on behalf of an injured worker. However, under certain circumstances the employer may be entitled to reimbursement of medical expenses and some attorney fees.
